01 General Provisions and Scope

This document constitutes a legal agreement between Artspace.dev (hereinafter the "Agency") and the User. It defines the rules for processing personal data and the principles of liability distribution. By using the Agency's website or establishing communication, you fully agree to these terms.

02 Legal Basis for Data Processing

The Agency processes data based on the following:

  • Consent of the Data Subject: Expressed by navigating the site or filling out a form.
  • Contractual Obligation: Necessary for preparing a service offer or a contract.
  • Legitimate Interest: Optimization of business processes, analytics, and cybersecurity.
  • Legal Obligation: Compliance with tax and legal requirements.

03 Categories of Collected Data

The Agency collects two types of information:

Automated Metadata: IP address, device type, browser language, and behavioral analytics (navigation history, session recordings via Google Analytics, Microsoft Clarity, and Hotjar).

Communication Data: Name, company, phone, email, social media profiles, and video call content/recordings.

04 Third-Party Service Providers

The Agency uses international platforms (Alphabet Inc., Microsoft Corp., Hotjar Ltd) for its operations. These services are independent contractors. The Agency uses their licensed software as an independent user and is not responsible for technical failures on the side of these providers.

05 Cross-Border Data Transfer

When using the services mentioned in Article 4, data may be processed outside of Georgia. The Agency selects these providers based on their high reputation and international security certificates, ensuring an adequate level of data protection.

06 Limitation of Liability and Legality of Assignment

6.1. Client Warranties: The client warrants that any assignment (brief), idea, or materials provided do not infringe upon the intellectual property of third parties.

6.2. Delegation of Liability: The Agency acts in accordance with the client's instructions and is not obliged to perform legal expertise on the assignment. Full liability for any infringement rests with the client.

6.3. Cybersecurity: The Agency uses TLS/SSL encryption but cannot accept liability for "Zero-Day" global cyber-attacks.

07 Data Retention Policy

  • Marketing/Analytical Data: Up to 26 months.
  • Business Correspondence and Briefs: 5 years (for legal dispute prevention).
  • Tax Documentation: Up to 10 years (as required by law).

08 User Rights

You have the right to request: access to your data, correction, deletion ("Right to be Forgotten"), restriction of processing, or data portability. The response time is 30 calendar days.

09 Intellectual Property in Data Context

Any analytical report or methodology created as a result of processing anonymous data constitutes the Agency's intellectual property. The client is granted only the right to use the final product.

10 Force Majeure and Dispute Resolution

Any disputes shall be resolved by the Common Courts of Georgia in accordance with the current legislation of Georgia.
